DMCA Policy
Charles Bronx Mcgregor ("we", "us", or "our") respects the intellectual property rights of others and is committed to complying with the provisions of the Digital Millennium Copyright Act ("DMCA"). This policy outlines the procedures for copyright owners to report alleged copyright infringement and for users to submit counter-notifications when their content has been removed due to a DMCA takedown notice.
Filing a DMCA Takedown Notice
If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible on our platform, please send a written DMCA Takedown Notice to our Designated Copyright Agent with the following information:
- Identification of the copyrighted work: Provide a detailed description of the copyrighted work that you claim has been infringed, including the registration number if applicable, or other evidence of your copyright ownership.
- Identification of the infringing material: Clearly identify the material that you claim is infringing and its location on our platform. Please provide the specific URL(s) where the material can be found.
- Contact information of the complaining party: Include your full legal name, mailing address, telephone number, and email address.
- A statement of good faith belief: A statement that you have a good faith belief that the use of the copyrighted material is not authorized by the copyright owner, its agent, or the law.
- A statement under penalty of perjury: A statement that the information in the notification is accurate, and under penalty of perjury, that you are the copyright owner or authorized to act on behalf of the copyright owner of an exclusive right that is allegedly infringed.
- Physical or electronic signature: A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
Filing a DMCA Counter-Notification
If your content has been removed or disabled as a result of a DMCA takedown notice, and you believe that the material was removed or disabled by mistake or misidentification, you may submit a Counter-Notification to our Designated Copyright Agent with the following information:
- Identification of the removed material: Identify the specific material that was removed or to which access was disabled, and the location (URL) where the material appeared before it was removed or disabled.
- A statement under penalty of perjury: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- Your contact information: Your name, address, and telephone number.
- Consent to jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which Charles Bronx Mcgregor may be found, and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
- Physical or electronic signature: Your physical or electronic signature.
